Agreement
These Terms govern access to and use of WixCargo, a multi-tenant software platform for motor carriers. By creating an account, signing in, or continuing to use the service, you accept these Terms on behalf of yourself and the motor carrier or business you represent (“Customer”).
If you do not agree, do not use the service. Questions may be directed to support@wixcargo.com before you rely on the product.
The service
WixCargo provides cloud software for small and mid-size carriers, including:
- Load and estimate management, fleet records (trucks and trailers), drivers, and clients/brokers
- Live maps, truck routing, optional smartphone location, and optional fleet telematics
- Driver portal (PIN and optional Quick ID sign-in, document uploads, chat, weather, incident reporting)
- Public broker tracking (map, invoice status, rate-change and dispute requests)
- Dispatch messaging (real-time chat with files and optional voice notes; Telegram and SMS when enabled)
- Invoicing, factoring package support, expenses, cash visibility, and driver payroll
- Compliance tools (documents, insurance, IFTA preparation, Broker Checker)
- Optional backhaul capacity matching between carriers
- Optional integrations (including QuickBooks Online and rate-confirmation document import)
- Workspace UI in English, Spanish, Romanian, and Russian
Features may change as the product develops. Availability of optional modules may depend on platform configuration and your company’s settings.
Nature of the service. WixCargo is software. It is not a law firm, CPA, payroll bureau, freight broker, FMCSA representative, or IFTA filing service. Organize your work in the platform; rely on qualified advisors for legal, tax, employment, and regulatory decisions.
Customer responsibilities
You agree to:
- Keep account and company information accurate
- Invite only authorized users and assign access appropriate to their roles
- Obtain any consents required before uploading driver, employee, broker, or client information
- Independently verify broker authority, insurance, payroll figures, tax filings, and compliance outcomes
- Safeguard passwords, optional Quick ID credentials on your devices, API credentials, exported files, and device access
- Use optional location, messaging, and tracking features in accordance with applicable law and your internal policies
- Manage Quick ID devices for your users (company Profile / platform Security, and driver Settings) and remove device credentials when phones or computers are lost, replaced, or no longer authorized
Acceptable use
Use WixCargo only to operate your carrier business. Do not attempt unauthorized access, upload malware, scrape other customers’ data, interfere with the service, or use the platform unlawfully.
We may suspend or terminate access for serious abuse, non-payment, or security risk, with notice where reasonably practicable.
Data roles
Our Privacy Policy describes how personal information is handled.
When you store driver, employee, or operational data in WixCargo, you are typically the controller and WixCargo acts as your processor / service provider, processing that data to provide the features you enable, on your instructions.
Integrations and third parties
Optional connections — including QuickBooks, Samsara, Motive, Mapbox, Twilio, Telegram, weather and fuel-price sources, email delivery, FMCSA public data, and AI document import when configured — are subject to those providers’ own terms. You control which integrations you enable. See the Privacy Policy for subprocessors that help operate the platform.
Supplementary usage charges
Certain features are billed outside the flat monthly subscription when enabled:
- Driver SMS — Each message sent to a driver is charged at the per-message rate shown in Integrations → Driver SMS before billing is acknowledged. Usage appears on your Stripe subscription as supplementary invoice items. You may disable driver SMS at any time.
Platform subscription fees do not include separate per-invoice or per-transaction platform markups on top of your monthly plan, except for optional usage you enable (such as driver SMS), which is billed to your company.
Subscription and billing
If your company uses a paid WixCargo plan, the following applies in addition to these Terms:
- Plans and trials. Monthly price, trial length, and custom pricing appear in Account → Subscription or in a written agreement. Trials convert to paid subscriptions unless cancelled before the trial ends.
- Renewal. Subscriptions renew automatically each billing period on the payment method on file until cancelled through Account → Subscription or another method we provide.
- Payment processing. We use Stripe to store payment methods, process charges, and issue invoices. By adding a payment method, you authorize WixCargo and Stripe to charge your company for the subscription, supplementary usage (such as driver SMS), and related Stripe processing amounts shown on your invoice. Your company pays these fees on the payment method you provide.
- Failed payments. We may retry failed charges, limit access after a reasonable grace period, or suspend the subscription until payment is resolved.
- Taxes. Fees exclude applicable taxes unless stated otherwise. You are responsible for sales, use, or similar taxes except where we are required to collect them.
- Price changes. Standard prices may change with reasonable notice. Custom pricing in your account or order form controls where applicable.
- Refunds. Except where required by law or stated in your order form, subscription fees are generally non-refundable once a billing period has begun.
Demo workspace
The demo uses sample data that resets when you leave. Do not enter real personal data, financial details, CDL numbers, or compliance documents in the demo.
Support access
Authorized WixCargo personnel may access tenant data when reasonably necessary for support, security, billing, or legal compliance. Access is limited to what is needed and logged where practical.
Warranties and limitations
The service is provided “as is” and “as available.” To the fullest extent permitted by law, WixCargo disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
Automated calculations and lookups — including truck route mileage, fuel and IFTA estimates (published diesel prices and optional route-weather adjustments), broker authority checks (FMCSA and public data), payroll withholdings, GPS-assisted load status, rate suggestions, AI document extraction, and integration syncs — are informational tools. Your team remains responsible for verifying amounts, authority, status, and compliance with your own records and advisors.
Limitation of liability. To the maximum extent permitted by law, WixCargo is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, loads, data, or regulatory penalties arising from use of the service. Total liability for any claim related to the service is limited to the fees you paid us in the twelve (12) months before the claim (or one hundred U.S. dollars if you have not paid fees), except where law does not allow that limit.
Indemnification. You agree to defend and hold WixCargo harmless from claims arising from your use of the service, your data, your breach of these Terms, or your violation of applicable law — including employment, tax, FMCSA, and privacy obligations.
Termination
You may stop using WixCargo at any time. We may terminate or suspend access with notice when reasonable. Before access ends, export your data using the tools in Settings. Your records remain yours.
SMS text messaging (Driver SMS)
When your company enables Driver SMS, WixCargo sends operational text messages to mobile numbers stored on driver profiles through our SMS provider (Twilio). This section describes what drivers and your staff should expect.
Types of messages
Depending on your settings, drivers may receive texts about:
- Document and upload requests (BOL, POD, and related paperwork)
- Load assignments, updates, and status changes
- Dispatch messages and operational alerts
- Links to the driver portal
- Safety-related notices your company configures (for example, drug-test scheduling where enabled)
These are operational messages tied to freight operations — not marketing or promotional blasts.
Message frequency
Message frequency varies based on load and dispatch activity. There is no fixed schedule or monthly cap; a driver may receive multiple messages on active days and fewer (or none) when idle.
Message and data rates
Msg & data rates may apply. Standard carrier messaging charges apply to recipients.
Consent
Consent is collected with an unchecked-by-default checkbox — not bundled into a general agreement. Carrier staff check the box on Add Driver / Edit Driver when they enter or change a mobile number. Drivers check the same box in driver portal Settings when they enter or update their own number. Hosted screenshots of both screens: https://wixcargo.com/sms-opt-in.
By checking the box and saving the number, the company (or the driver) confirms agreement to receive recurring operational SMS from the motor carrier via WixCargo for the purposes described above. You are responsible for obtaining and documenting any consent required under applicable law before texting drivers.
Mobile information is not shared for marketing
We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.
Opt-out
Drivers may opt out at any time by replying STOP to a message. When we receive a valid STOP request, we send one confirmation message and no further operational SMS will be sent to that number through Driver SMS unless the driver opts back in (for example by replying START) or your company updates the number with fresh consent as allowed by law. Drivers may also contact your dispatch office or email support@wixcargo.com with SMS questions.
See our Privacy Policy for how mobile numbers are handled, including our non-marketing sharing commitments.
Billing
Driver SMS is billed separately from your subscription at the per-message rate shown in Integrations → Driver SMS before you enable the feature.
Changes to these Terms
We may revise these Terms as the product or law requires. Material changes will be posted with a new effective date and, where required, acceptance of the updated version will be requested. Continued use after changes constitutes acceptance where the law allows.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, excluding conflict-of-law rules, unless your order form states otherwise. Disputes are handled in Delaware courts or through binding arbitration if agreed in writing.
